Secret Warrantless Searches May Have Lead to Another Child Porn Arrest

ROCKLAND, Maine—The State Police Computer Crimes Unit recently arrested a Rockland man and charged him with possessing child pornography. 32 year-old Jarrod Bergeron was arrested at his home at 58 Acadia Drive and was taken to the Knox County Jail.

   Detectives began investigating Bergeron late last year after receiving a tip. His home was searched on December 15 and his computers were taken back to the computer crime unit's offices in Vassalboro to be analyzed. That exam revealed 130 sexually explicit images of 37 children under the age of 12.  Bergeron's court date will be March 21. State Police say assisting in the investigation were the Department of Homeland “Security” and Rockland Police. Bergeron has been employed as a cook in Camden.

  The mention of the Department of Homeland “Security” assisting in the investigation is a clue to how the tip might have been received to begin with.  Over the past decade, the Department of Homeland “Security,” through the National Security Agency (NSA), has been covertly spying on all computer users in the U.S., not for national security reasons but to search for those looking at child porn and other petty illegal activities on the internet.  They conduct the web-wide searches arbitrarily without a warrant, in violation of the 4th amendment to the U.S. Constitution, then tip the local police who get around warrant requirements for the initial search by saying it was an “anonymous tip” without revealing their sources.  This is a violation of the 6th amendment to the U.S. Constitution which guarantees the right of the accused to confront the witnesses against him. In these cases, the anonymous tipsters likely are employees at the Department of Homeland “Security” who do not have to be called as witnesses, deposed, or submit to a defense attorney’s cross examination.  Without the ability to cross examine the original source of the tip, it is nearly impossible for a defendant to show if they were set up or “framed” for the crime in which they are answering to.   This is why the 4th and 6th amendments were placed into the U.S. Constitution’s Bill of Rights.

   The reason the DHS is usually classified as an “anonymous” source for the tip and not publicly announced in court is they would have to admit they were literally conducting an unlawful blanket search without any probable cause, or lawfully obtained search warrant.

   For the past several years, nearly all child porn related arrests in Maine were for mere possession of pictures or videos, not for any direct sexual contact with underage children.
